1.3. All for Fighters is a trading brand used by HelpFit s.r.o.

1.4. The Buyer is any natural person or legal entity who enters into a purchase contract with the Seller through the Online Store.

1.5. These Terms and Conditions form part of the purchase contract. Any individual agreement expressly concluded between the Seller and the Buyer shall prevail over these Terms and Conditions to the extent permitted by applicable law.

1.6. A purchase contract may be concluded through the Online Store in Slovak or English.

1.7. The Online Store is not an online marketplace through which third parties independently offer their goods to consumers. The seller of the goods offered through the Online Store is HelpFit s.r.o., unless expressly stated otherwise for a particular product.

2. Consumer and Business Customer

2.1. A Consumer is a natural person who, when concluding and performing a consumer contract, does not act within the scope of their trade, business, employment or profession.

2.2. A Business Customer is a Buyer who purchases goods in connection with their business or professional activity.

2.3. The inclusion of a company identification number, business name or other business details in an order is a significant indication that the Buyer is purchasing in connection with their business activity. However, the actual purpose of the purchase is decisive.

2.4. Provisions of these Terms and Conditions expressly intended for Consumers shall not apply to Business Customers unless applicable law provides otherwise.

3. Goods and product information

3.1. Through the Online Store, the Seller sells mainly sports equipment, clothing, protective equipment and accessories intended for combat sports and related sporting activities.

3.2. The main characteristics of the goods are stated on the individual product pages in the Online Store.

3.3. Product photographs are intended to represent the goods as accurately as possible. Colours may vary slightly depending on the device or display used.

3.4. Handmade products may have minor natural variations in workmanship, stitching, material texture or colour shade, provided that such variations do not affect the agreed characteristics, safety or functionality of the product.

3.5. The preceding provisions do not limit the Seller's statutory responsibility to ensure that the goods supplied comply with the agreed description, type, quantity, quality and other requirements laid down by applicable law.

3.6. The designation “In stock” means that the product or the relevant variant is available according to the Seller's current stock records.

3.7. The designation “Available to order”, “on order” or similar wording means that the Seller obtains the product from its supplier or manufacturer.

3.8. The delivery time stated for goods available to order is estimated. If, after receiving the order, the Seller discovers that the product is unavailable from the supplier or that delivery will be significantly delayed, the Seller shall inform the Buyer without undue delay.

3.9. In the event of a delay, the Seller may propose a new delivery date or another solution. Any amendment to an already concluded contract requires the Buyer's consent.

4. Prices

4.1. Prices displayed in the Online Store are final prices and include VAT, unless otherwise stated for a particular offer or due to the applicable tax treatment of the order.

4.2. The price displayed to the Buyer during the checkout process before the order is submitted is decisive for the particular order.

4.3. Before submitting the order, the Buyer is shown the price of the goods, the price of the selected delivery method, any charge associated with the selected payment method and the total price of the order.

4.4. Current delivery prices are not fixed by these Terms and Conditions. The Seller may change them for future orders according to carrier prices, destination country, weight, dimensions of the shipment or other relevant conditions.

4.5. The specific delivery price displayed to the Buyer during checkout before submitting the order shall not change for that order after the purchase contract has been concluded.

4.6. The Seller may change product prices for future orders. A price change does not affect an already concluded purchase contract.

4.7. Obvious pricing error

If, as a result of a technical error, administrative error or system failure, a product is displayed at a price that is obviously incorrect and the Buyer could or should have recognised in the circumstances that the price was erroneous, the Seller is not obliged to confirm the order at that incorrect price.

If the contract has already been concluded and an obvious pricing error is subsequently established, the Seller and the Buyer shall attempt to resolve the situation by agreement. This is without prejudice to the rights and obligations of the parties under applicable law.

An obvious error may include, in particular, a missing or additional digit or another price that is clearly inconsistent with the nature and usual value of the goods. An ordinary price change or ordinary commercial discount shall not be considered an obvious pricing error.

5. Orders and conclusion of the purchase contract

5.1. The Buyer creates an order by adding the selected goods to the shopping cart, selecting an available delivery and payment method and entering the required information.

5.2. The Buyer is required to provide complete, accurate and truthful information.

5.3. Before submitting the order, the Buyer has the opportunity to review and correct the entered information, selected goods, quantity and variant, delivery method, payment method and total price.

5.4. The order is submitted by means of a button or similar function which clearly indicates that submitting the order entails an obligation for the Buyer to pay the price.

5.5. By submitting the order, the Buyer submits a binding proposal to the Seller to conclude a purchase contract.

5.6. After receiving the order, the Seller shall send the Buyer an electronic order confirmation containing a summary of the order to the e-mail address stated in the order.

5.7. The purchase contract between the Seller and the Buyer is concluded when the electronic order confirmation is delivered to the Buyer.

5.8. The Seller provides the order confirmation and the relevant contractual information to the Buyer electronically on a durable medium to the extent required by applicable law.

5.9. If, after conclusion of the contract, the Seller discovers that the ordered goods cannot be obtained, for example because the manufacturer or supplier has discontinued their production or supply, the Seller shall inform the Buyer without undue delay.

5.10. The Seller may propose replacement goods, an amendment to the order or a new delivery date. The Buyer is not obliged to accept such a change.

5.11. If delivery of the ordered goods becomes objectively impossible and the impossibility cannot be overcome through reasonable efforts, the Seller shall proceed in accordance with applicable law. If the contract is terminated or otherwise comes to an end, the Seller shall refund all payments received for the undelivered goods without undue delay.

6. Storage of the contract and correction of data

6.1. The purchase contract is stored by the Seller electronically in accordance with applicable law and the Seller's internal rules.

6.2. The Buyer does not have direct access to the Seller's internal archive.

6.3. However, the Buyer receives the order confirmation and relevant contractual information electronically so that they can be stored and reproduced.

6.4. Before submitting an order, the Buyer can review and correct the entered information through the checkout form.

7. Payment terms

7.1. The payment methods currently available are displayed to the Buyer during the checkout process.

7.2. Depending on the particular order, the Seller provides in particular the following payment methods:

  • online payment through the Shoptet Pay payment gateway,
  • bank transfer,
  • cash on delivery for shipments to Slovakia or the Czech Republic, where available for the selected delivery method and particular order.

7.3. In the case of bank transfer, the Buyer must pay for the order according to the payment instructions and within the period stated in the order confirmation or payment instructions.

7.4. Payments made through a payment gateway are also subject to the technical and security rules of the relevant payment service provider.

7.5. For personal collection, the order must be paid in advance online or by bank transfer. Payment at the collection point is not available unless expressly stated otherwise by the Seller.

7.6. The Seller issues invoices electronically and provides them to the Buyer in electronic form.

7.7. The Buyer agrees to the issuance and delivery of the invoice in electronic form.

7.8. Ownership of the goods passes to the Buyer only after the purchase price has been paid in full and the goods have been delivered.

8. Delivery, personal collection and receipt of goods

8.1. The delivery methods, carriers, destination countries and shipping charges currently available are displayed to the Buyer during checkout. An indicative overview of destination countries and shipping rates is available on the Shipping Rates page. The shipping charge displayed to the Buyer before submitting the order is decisive for that particular order.

8.2. Depending on current availability, the Seller uses in particular the services of DPD, Packeta and Slovak Post. Availability of a particular carrier and delivery method may vary according to the destination country, order, dimensions or weight of the shipment.

8.3. The delivery options displayed during checkout are decisive for the particular order.

8.4. The Seller shall deliver the goods within the agreed period. If no specific delivery period has been agreed, the goods shall be delivered without undue delay and no later than within the period required by applicable law.

8.5. For goods marked as “Available to order”, restocking is generally estimated to take up to 7 business days, unless otherwise stated on the relevant product page. This is an estimated restocking period, not the total delivery time to the Buyer. Transit time begins only after the shipment has been dispatched. The Seller shall inform the Buyer without undue delay of any significant delay. This is without prejudice to the Buyer's statutory rights in the event of delayed delivery.

8.6. Goods are deemed delivered to a Consumer when the Consumer or a third party designated by the Consumer, other than the carrier, takes physical possession of them.

8.7. If the Consumer commissions a carrier that was not offered by the Seller, the risk of loss of or damage to the goods passes to the Consumer upon delivery of the goods to that carrier to the extent provided by applicable law.

8.8. Upon receipt of the shipment, the Buyer is advised to inspect the condition of the packaging. If the shipment shows signs of damage, the Buyer is advised to document the damage and, where possible, record it with the carrier.

8.9. Failure to follow the recommendation in Section 8.8 does not in itself deprive the Consumer of statutory rights arising from liability for defects.

8.10. Personal collection is available by prior arrangement at the All for Fighters showroom, Dolná 43, 974 01 Banská Bystrica, Slovak Republic. The order must be placed through the Online Store and paid for in advance online or by bank transfer. The Seller will notify the Buyer when the order is ready for collection.

8.11. If a shipment is delivered outside the customs territory of the European Union and the checkout process does not expressly state that the applicable import duties, taxes or other local charges are included in the price, such charges may be payable by the Buyer under the laws of the destination country.

9. Failure to accept ordered goods

9.1. Merely failing to accept a shipment without justification does not constitute withdrawal from the purchase contract.

9.2. If the Buyer fails to accept the shipment without legal justification and the shipment is returned to the Seller, the Seller may request that the Buyer arrange or accept repeated delivery.

9.3. If repeated delivery is necessary for reasons attributable to the Buyer, the Seller may require reimbursement of reasonable and demonstrably incurred costs associated with the unsuccessful and repeated delivery.

9.4. If the Buyer fails to provide the necessary cooperation for receipt of the goods even within a reasonable additional period, the Seller may exercise the rights available under applicable law, including withdrawal from the contract where the statutory conditions are met.

9.5. This does not affect the Consumer's statutory right to withdraw from the contract in accordance with the following Article.

↑ Back to contents

10. Consumer's right to withdraw from the contract without giving a reason

10.1. Withdrawal period

A Consumer has the right to withdraw from a distance contract without giving any reason within 14 days.

For the purchase of goods, the withdrawal period begins on the day on which the Consumer or a third party designated by the Consumer, other than the carrier, takes possession of the goods.

If goods ordered in a single order are delivered separately, the withdrawal period begins on the day on which the Consumer takes possession of the last item delivered.

If the goods consist of several parts or pieces delivered separately, the withdrawal period begins on receipt of the last part or piece.

The Consumer may send the withdrawal notice even before the withdrawal period begins.

10.2. How to withdraw

The Consumer may withdraw from the contract by making an unequivocal statement, in particular:

  • by e-mail to eshop@allforfighters.eu,
  • in writing to HelpFit s.r.o., Nová 21, 974 04 Banská Bystrica, Slovak Republic,
  • by using the model withdrawal form,
  • by using the dedicated online withdrawal function available through the My Order page.

Use of the model withdrawal form is not a condition for valid withdrawal from the contract.

10.3. Online withdrawal

The Consumer may use the online withdrawal function available through the My Order page.

After entering the information necessary to identify the customer and the order, the Consumer can access the order details and the available withdrawal function.

After the withdrawal is submitted electronically, the Seller shall provide the Consumer with confirmation of receipt on a durable medium, including the information required by applicable law.

10.4. Compliance with the withdrawal period

The withdrawal period is met if the Consumer sends the withdrawal notice to the Seller no later than on the last day of the applicable withdrawal period.

10.5. Returning the goods

The Consumer must send or hand over the goods no later than 14 days after withdrawing from the contract to:

HelpFit s.r.o.
Nová 21
974 04 Banská Bystrica
Slovak Republic

The deadline is met if the Consumer sends the goods before the 14-day period has expired.

The Consumer bears the direct cost of returning the goods unless the Seller has expressly stated that it will bear those costs.

Please do not return goods by cash on delivery unless otherwise agreed with the Seller in advance.

10.6. Inspection and condition of returned goods

The Consumer may handle the goods only to the extent necessary to establish their nature, characteristics and functioning, in a manner comparable to reasonable inspection in a physical store.

For sports equipment, trying on the size, fit or basic adjustment is different from using the goods during training, sparring, heavy bag work, pad work or another sporting activity.

If the Consumer handles the goods beyond what is necessary for this purpose and this results in a reduction in their value, the Consumer is liable for that reduction in value to the extent provided by applicable law.

The Seller recommends returning the goods clean and complete and, where possible, together with the original packaging, labels and accessories.

The absence or opening of the original packaging does not in itself automatically result in the loss of the Consumer's right of withdrawal, unless a statutory exception to the right of withdrawal applies.

10.7. Refunds

The Seller shall refund all payments that it is legally required to refund no later than 14 days from the date on which the Seller receives the Consumer's notice of withdrawal.

However, the Seller is not required to refund payment for the goods before the goods have been returned or the Consumer provides evidence that the goods have been sent back, whichever occurs first.

The Seller shall make the refund using the same means of payment used by the Consumer for the original transaction, unless the Consumer has expressly agreed otherwise with the Seller and provided that the Consumer does not incur additional costs as a result.

If the Consumer selected a more expensive method of original delivery than the least expensive standard delivery method offered by the Seller, the Seller is only required to reimburse delivery costs up to the amount corresponding to the least expensive standard delivery method offered.

10.8. Partial withdrawal

If a single order contains several separate items, the Consumer may withdraw from the contract only in relation to some of those items where the nature of the contract allows this.

10.9. Gifts and free bonuses

If a free gift or bonus was provided with goods or an order solely on condition that a particular purchase was made and, as a result of withdrawal from the contract, the Consumer no longer fulfils the conditions for receiving that gift or bonus, the Seller may require the gift to be returned together with the returned goods, unless applicable law or the terms of the particular promotion provide otherwise.

In the case of partial withdrawal, this rule applies only if, as a result of the partial withdrawal, the conditions under which the gift or bonus was provided are no longer fulfilled.

10.10. Exceptions to the right of withdrawal

The Consumer does not have the right to withdraw from the contract in the cases provided for by applicable law.

For the Seller's product range, relevant exceptions may include in particular:

  • goods made to the Consumer's specifications or clearly personalised,
  • goods liable to deteriorate or expire rapidly,
  • goods which, after delivery, are inseparably mixed with other goods due to their nature,
  • sealed goods which are not suitable for return due to health protection or hygiene reasons and which were unsealed after delivery.

The exception concerning sealed goods applies only where the statutory conditions for that exception are met for the particular product.

11. Liability for defects – Consumer

11.1. The Seller is liable to the Consumer for any defect which the goods have at the time of delivery and which becomes apparent during the statutory liability period.

11.2. For new goods, the Seller is liable for defects that become apparent within two years from delivery of the goods, unless applicable law provides otherwise.

11.3. If a defect becomes apparent during the statutory period, the rules concerning the burden of proof under applicable law shall apply.

11.4. The Consumer may exercise rights arising from liability for defects only if the defect is notified within two months of its discovery and no later than before expiry of the applicable liability period.

11.5. Extension following the first repair

After the first removal of a defect by repair, the statutory liability period for defects is extended by 12 months.

This extension applies only once, regardless of the number of any subsequent repairs.

Before removing the defect, the Seller shall inform the Consumer of the Consumer's right to choose between repair and replacement to the extent provided by law and of the extension of the liability period following the first repair.

12. Making a complaint / notifying a defect

12.1. The Consumer may notify the Seller of a defect in particular:

  • by e-mail to eshop@allforfighters.eu,
  • in writing at the Seller's address,
  • in person at a location designated by the Seller for this purpose,
  • by another method permitted by applicable law.

12.2. Notification of a defect is not conditional upon the defective goods being physically delivered to the Seller at the same time.

12.3. If physical examination of the product is necessary to determine or remedy the defect, the Consumer shall provide reasonable cooperation and allow the Seller to take possession of the goods or send the goods to the Seller in accordance with the agreed procedure.

12.4. The Consumer may use the complaint form contained in these Terms and Conditions; however, use of the form is not a condition for valid notification of a defect.

12.5. The Consumer is advised to provide in particular:

  • name and contact details,
  • order number or another detail enabling identification of the purchase,
  • the product concerned,
  • a description of the defect,
  • the date on which the defect was discovered,
  • the requested method of remedy.

12.6. The Consumer must be able to demonstrate that the relevant goods were purchased from the Seller. An invoice is an appropriate means of proving the purchase, but it is not the only possible means if the purchase can be reliably proven otherwise.

12.7. The Seller shall provide the Consumer with written confirmation of the notification of the defect without undue delay.

12.8. The Seller shall state in the confirmation the period within which the defect will be remedied in accordance with applicable law.

13. Handling of Consumer complaints

13.1. If the Seller is liable for the defect, the Consumer has the right, subject to the conditions laid down by law, to choose to have the defect remedied by:

  • repair of the goods, or
  • replacement of the goods.

13.2. The Consumer may not choose a method of remedy that is impossible or that, compared with the alternative method, would impose disproportionate costs on the Seller taking all circumstances into account.

13.3. If neither repair nor replacement is possible or either would require disproportionate costs, the Seller may refuse to remedy the defect to the extent permitted by law.

13.4. The Seller shall remedy the defect free of charge, at its own expense, within a reasonable period and without causing significant inconvenience to the Consumer.

13.5. The period for remedying the defect shall not exceed 30 days from the date on which the defect is notified, unless a longer period is justified by an objective reason beyond the Seller's control.

13.6. Subject to the conditions laid down by law, the Consumer is entitled to an appropriate price reduction or to withdraw from the purchase contract, in particular where:

  • the Seller has not repaired or replaced the goods,
  • the Seller has refused to remedy the defect under circumstances permitted by law,
  • the same defect remains despite repair or replacement,
  • the defect is sufficiently serious,
  • the Seller has declared, or it is clear from the circumstances, that the defect will not be remedied within a reasonable period or without significant inconvenience to the Consumer.

13.7. Where the Consumer exercises the right to withdraw from the contract due to a defect, the statutory limitations apply, including the restriction on withdrawal in the case of a negligible defect to the extent provided by law.

13.8. If the Seller refuses liability for a defect, the Seller shall notify the Consumer in writing of the reasons for the refusal.

13.9. If the Consumer subsequently proves the Seller's liability for the defect by means of an expert opinion or expert assessment envisaged by applicable law, the Consumer may notify the defect again subject to the conditions laid down by law.

13.10. The Seller does not provide a separate voluntary consumer guarantee under Section 626 of the Slovak Civil Code unless expressly stated otherwise for a particular product, in a guarantee statement or in related advertising.

This does not affect the Consumer's statutory rights arising from liability for defects or any rights arising from a separate manufacturer's guarantee.

14. Normal wear and damage to goods

14.1. The Seller is not liable for damage arising after delivery of the goods as a result of circumstances attributable to the Buyer, including in particular:

  • normal wear and tear corresponding to the nature, expected lifespan and intensity of use of the product,
  • use of the goods contrary to their intended purpose,
  • mechanical damage caused after delivery,
  • incorrect washing or cleaning or the use of unsuitable chemical products,
  • failure to follow instructions for use or maintenance,
  • inappropriate storage, prolonged exposure to moisture, excessive heat or other unsuitable conditions,
  • intervention in or modification of the goods by the Buyer or a third party where such intervention caused the defect.

14.2. Sports equipment used for contact and combat sports may naturally show wear of materials, surface finishes, padding, fastening systems, prints or other components depending on the intensity and manner of use. Normal wear and tear does not in itself constitute a defect.

14.3. The preceding provisions do not exclude the Seller's liability for a manufacturing defect, material defect or another defect for which the Seller is liable under applicable law.

14.4. Protective sports equipment is intended to reduce the risk of injury, not to eliminate it completely. The Buyer must use the equipment in accordance with its intended purpose, instructions, correct size and the rules of the relevant sporting activity.

14.5. The preceding paragraph does not limit liability for defective or unsafe products under applicable law.

15. Special terms for Business Customers – B2B

15.1. If the Buyer enters into the contract in connection with their business activity, the contractual relationship shall be governed by the rules applicable to Business Customers and the relevant provisions of Slovak law.

15.2. A Business Customer does not have the statutory consumer right to withdraw from the contract without giving a reason within 14 days.

15.3. The Seller may voluntarily allow a Business Customer to exchange or return goods on the basis of an individual agreement.

15.4. The Business Customer is required, where reasonably possible, to inspect the goods as soon as possible after delivery.

15.6. In the case of a hidden defect, the Business Customer must notify the Seller without undue delay after discovering the defect and no later than within the periods prescribed by applicable law.

15.7. The Seller does not provide the Business Customer with a guarantee of quality unless expressly provided for a particular product, in a separate agreement or in a guarantee statement.

15.8. The provisions of Article 14 relating to normal wear and tear, improper use, maintenance and damage to goods shall apply accordingly to Business Customers.

15.9. Individual terms agreed under the Club Program, wholesale cooperation or another B2B arrangement shall prevail over these general provisions to the extent of the individual agreement.
